Trump Wants ‘Communists’ and ‘Marxists’ Out Law states: Trump has announced a new campaign proposal regarding United States immigration, which would bar “communists” and “Marxists” from entering the country.

Former President George W. Bush, who is running for reelection in 2024, said on Saturday that he would use “Section 212 (f) of the Immigration and Nationality Act” to “deny entry to all communists and all Marxists.”

The announcement evoked memories of Trump’s ban on travelers from several predominantly Muslim countries during his first term, which was heavily criticized as anti-Muslim and eventually rescinded by President Biden.

Trump said at a conference in Washington of the Faith and Freedom Coalition, “Those who want to enjoy our country must love our country,” adding, Trump Wants ‘Communists’ and ‘Marxists’ Out Law states “We’ll keep out foreign communists, Marxists, and socialists who hate Christianity.”

In addition, Trump’s proposal raised questions about whether an outdated law could actually be used to ban all communist and Marxist immigrants to the Trump Wants ‘Communists’ and ‘Marxists’ Out Law states , how such a ban would work, and why he is so focused on these political theories in a country with few adherents.

Here are some examples of existing U.S. laws and how Trump’s proposal may look:

What Is The Current Law In The U.S. Regarding This Issue?

Members of the Communist Party are already prohibited from becoming naturalized citizens or green card holders under U.S. immigration law, according to Andrew Arthur, a former immigration judge and fellow at the Center for Immigration Studies, a Trump Wants ‘Communists’ and ‘Marxists’ Out Law states Washington, D.C.-based think tank advocating a reduction in immigration.

According to the U.S. Immigration Law, any immigrant “… affiliated with or a member of the Communist Party or any other totalitarian party (or subdivision thereof) is inadmissible.”

That rule originated in 1918 when the U.S. government began to be concerned about “external threats of anarchism and communism,” according Trump Wants ‘Communists’ and ‘Marxists’ Out Law states to the Trump Wants ‘Communists’ and ‘Marxists’ Out Law states imigration and Citizenship Policy Manual. During that time, World War I had also ended, communism was establishing itself in the Soviet Union, and strict immigration quotas would soon be implemented in the United States.

There are, however, some exceptions. A person who became a member of the Communist Party as a condition of getting a job, or a person who became a member of the Communist Party while under the age of 16.

Also, the prohibition does not apply to visitors on a tourist or student visa who wish to enter the United States.

During his speech Trump said he would use a particular section of U.S. immigration law – Section 212 (f) – to bar “all communists and all Marxists”. Under that section, the government has broad authority to exclude foreigners from entering the country if their entry is detrimental to the United States’ interests.

    What Precedents Exist For This?

According to Trump, excluding communists and Marxists is reminiscent of one of the more controversial actions of his administration, often referred to as Trump Wants ‘Communists’ and ‘Marxists’ Out Law states a travel ban on Muslims. As part of their Trump Wants ‘Communists’ and ‘Marxists’ Out Law states argument, opponents cited Trump’s own tweets and rhetoric as evidence that the travel ban discriminated against Muslims.

However, the Supreme Court ruled 5-4 in Trump’s favor. In the majority opinion, Chief Justice John Roberts stated that the justices were not deciding whether or not it was a good policy, but that it was well within the president’s considerable authority over immigration and responsibility for keeping the nation safe.

As a result of that case, Arthur believes that Trump is on sound legal ground if he tries to bar communists or Marxists from entering the United States. Aside from this, Arthur also stated that foreign nationals seeking entry into the United States have little in common with American citizens in terms of constitutional rights.

President Trump is not the first to utilize this specific power under immigration law in limiting the number of immigrants permitted to enter the U.S. The Congressional Research Service reported in 2020 that it had been used by a number of presidents, but that Trump utilized the authority in a more restrictive manner than his predecessors had.

Who would be affected by this plan if Donald Trump were elected president?

A number of analysts point to one country in particular: China, where tens of millions of people are Communist Party members.

The Asia Society is represented by Bates Gill, the executive director of the Center for China Analysis. In his opinion, such a ban would have the greatest impact on China and should be viewed in that light. Additionally, Gill pointed out that party membership has Trump Wants ‘Communists’ and ‘Marxists’ Out Law states historically been a pathway for the upwardly mobile in China, who are often well-educated, urban, and international in outlook. As of the late 1990s, businesspeople have also become members of the party, according to Gill.

In essence, you would be prohibiting the elites of China from entering the United States. A decision of this magnitude would have a profound impact on our relations with China, and it would be vast and sweeping.”

Reason For Trump’s Frequent Mention Of Them: Trump Wants ‘Communists’ and ‘Marxists’ Out Law states

The former president has been successful in energizing his base by seeding fears that communists and Marxists will take over the country.

The United States is not at risk of becoming a “third world Marxist regime,” as Trump has suggested; however, these attacks have helped him target voters’ emotions in a country with a long history of anticommunism.

In addition, Trump has used this tactic to appeal to some immigrants whose families had been subjected to oppression and political persecution under Communist regimes in countries such as Venezuela, Cuba, and Vietnam.

Since Trump first appeared on the political scene, he has also baselessly referred to Democratic rivals with these terms, but Florida Gov. Recently, Trump Wants ‘Communists’ and ‘Marxists’ Out Law states other Republicans have joined in with similar attacks, claiming “woke” policies in America are part of Marxist agendas.

According to experts, it is incorrect to assert that communists or Marxists control major institutions in the United States.

For instance, Vice President Biden is a proponent of capitalism who has taken executive action to promote economic competition.
